Krishna, learned counsel for the respondent No.2. 2. The petitioner has sought for a direction to Respondent No. 4 to consider the representation dated 19.08.2025, produced at Annexure-C, inter-alia seeking mutation of the revenue entries in his name in respect of land bearing Sy. No. 67/P1 (New Sy. No. 67), measuring 4 acres, situated at Kommagatta Village, Kengeri Hobli, Bengaluru South Taluk. 3. Sri. Srinivas V., learned counsel appearing for the petitioner, while referring to the RTC extract produced at Annexure-A, submitted that the total - 4 - HC-KAR NC: 2026:KHC:25791 WP No. 36031 of 2025 extent of land in Sy. No.67 is shown as 75.38 acres. He contended that the petitioner is the owner of an extent of 4 acres in the said survey number and, therefore, sought a direction to Respondent No. 4 to effect mutation of the revenue entries in favour of the petitioner. 4. Per contra, Sri K. Krishna, learned counsel appearing for the Bengaluru Development Authority (BDA), drawing attention to the averments made in the statement of objections, and submitted that an extent of 2 acres 33 guntas in Sy. No.67 of Kommagatta Village, Kengeri Hobli, Bengaluru South Taluk, has been acquired by the BDA. He further submitted that, insofar as the remaining extent is concerned, there is no impediment for the Tahsildar to consider the representation submitted by the petitioner. - 5 - HC-KAR NC: 2026:KHC:25791 WP No. 36031 of 2025 5. Smt. B.P. Radha, learned Additional Government Advocate appearing for the respondent- State submitted that the petitioner is required to establish his right, title and interest over the property in question before seeking mutation of the revenue entries in his name. 6. Having considered the submissions made by the learned counsel appearing for the parties and on perusal of the material on record, it is noticed that the petitioner claims ownership over an extent of 4 acres in Sy. No. 67 of Kommagatta Village. The records further disclose that the petitioner has submitted a representation dated 19.08.2025, produced at Annexure-C, seeking mutation of the revenue entries in his favour on the basis of the judgment and decree passed in O.S. No. 1813/2024 on the file of the IV Additional Senior Civil Judge, Bengaluru Rural District. - 6 - HC-KAR NC: 2026:KHC:25791 WP No. 36031 of 2025 It is also not in dispute that a portion of the land in Sy. No. 67, to an extent of 2 acres 33 guntas, has been acquired by the Bengaluru Development Authority. In that view of the matter, this Court is of the opinion that there is no impediment for Respondent No. 4-Thasildar to consider the representation dated 19.08.2025, produced at Annexure-C, in accordance with law and in the light of the judgment and decree passed in O.S. No. 1813/2024. 7. Accordingly, Respondent No. 4 is directed to consider the petitioner's representation dated 19.08.2025, produced at Annexure-C, and take an appropriate decision in accordance with law, after affording an opportunity of hearing to all concerned parties, within an outer limit of two months from the date of receipt of a certified copy of this order.
