Ajay Mohan Goel, Judge (Oral) By way of instant petition, the petitioner has, inter alia, prayed for the following reliefs:- “a) The present petition may kindly be allowed and impugned letter dated 05.08.2026 (Annexure P-5) and office order dated 06.08.2026 (Annexure P-8) may kindly be quashed and set aside; b) The respondents may kindly be directed to treat petitioner's absence from 02.08.2026 to date of expiry of medical certificate as absence on leave and subsequent joining time for placement as continuing and subsisting; c) The respondents may kindly be directed to grant the petitioner a fresh & meaningful opportunity enabling him, either to forgo the placement or to represent for his adjustment at Mandi.” -2- 2. After making his submissions for some time, learned counsel for the petitioner submits that he has instructions to state that the petitioner forgoes his placement from the post of Veterinary Officer to the post of Senior Veterinary Officer in terms of Notification P-3, dated 20.7.2026. His statement is taken on record. It is ordered that the petitioner shall be construed to be serving as a Veterinary Officer only, of course, at the place where he was serving before the issuance of Notification dated 20.7.2026, in the light of the fact that the petitioner has forgone his placement to the post of Senior Veterinary Officer, Office Order dated 6.8.2026, in terms whereof the petitioner was ordered to be relieved from his duty in absentia and the same has become otiose and is declared as such. 3. It goes without saying that as the petitioner has forgone his placement against the post of Senior Veterinary Officer, the Department will not be taking any punitive action against him for not joining at Shimla against the post of Senior Veterinary Officer. 4.
