THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 486/2019
JUDGMENT:
When the matter is taken up for hearing, there is no representation on behalf of the petitioner. Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State and Mrs. T.V.Sri Devi, learned counsel for the respondent No.1 is in attendance.
2. This Criminal Revision Case has been filed challenging the impugned
order dated 06.03.2019 passed by the learned Judge, Family Court-cum-III Additional District and Sessions Judge, Vizianagaram, in FCMC.No.65 of 2019, granting maintenance @ Rs.5,000/- per month to the wife of the petitioner. Since, this is a revision preferred against the impugned order, this Court is inclined to proceed with the matter and dispose of the case on merits. Perused the record.
3. The impugned order would show that there is no dispute between the parties regarding their relationship as husband and wife. Admittedly, respondent No.1 herein, being the wife, is residing separately from the husband and is staying at her parental home. Nothing has been placed on record to establish that the wife is able to maintain herself. It is not the case of the husband that he is contributing any amount towards her maintenance. The wife contended that the husband is running a watch showroom, apart from engaging in finance and real estate businesses, and earning about Rs.10,00,000/- per annum. However, the petitioner/husband categorically
4
denied the same and deposed that he is only a watch repair mechanic who also recharges mobile phones in a small shop and earns less than Rs.5,000/- per month after meeting expenses. The learned Judge took into consideration Ex.P.5 photographs showing the husband’s shop and a cash receipt, and observed that the husband has no other liabilities except to maintain his wife. Upon appreciation of the material on record, the learned Judge awarded maintenance at the rate of Rs.5,000/- per month from the date of filing of the petition. This Court finds no ground to interfere with the impugned order.
4. In view of the above said facts and circumstances, this Court is of the view that the impugned order is a well reasoned one and there are no grounds warranting the interference of this Court.
5. Accordingly, this Criminal Revision Case is dismissed.
Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 20.02.2026. UPS
