Rakib (Rejected) CRM (M) 260 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sagarpara Police Station case no. 101 of 2023 dated 17.04.2023 under Sections 341/302/326/307/34 of the Indian Penal Code and under Sections 25/27 of the Arms Act. Learned advocate appearing for the petitioner submits that petitioner is in custody for about eleven months and there is no possibility of the trial being concluded in near future, as such petitioner may be released on bail. On the other hand learned advocate for the State submits that 22 witnesses have been examined and the examination-in- chief of the investigating officer has been completed and date has been fixed for further cross-examination of the investigating officer. Having considered the stage of the case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner in CRM (M) 260 of 2026 is dismissed. 2 Learned trial Court has already fixed date for concluding the evidence of the investigating officer on 08.04.2026 and 09.04.2026. Having regard to the date being fixed for evidence of the investigating officer of the case, the learned trial Court would pronounce the verdict by 30th of June, 2026. If the investigating officer of the case is present, his further appearance before this Court is dispensed with. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
