ORAL ORDER
1. Notice to respondents is dispensed with in view of the proposed order to be passed. 2. Petitioner is before this Court seeking for the following reliefs: a. Issue a writ of certiorari, quashing the compromise joint petition dted 08.06.2023, and Lok Adalath order dated:

08.06.2023, and Lok Adalath order dated: 08-07-2023 passed by the Court of II Additional Senior Civil Judge & JMFC at Kolar in O.S.NO.462/2022 produced as per Annexure-B and C and allow this writ petition, to meet the ends of justice. b. Issue any other writ, order or direction as this Hon'ble court deems fit to grant in the circumstances of the case, to meet the ends of justice. 3. The short grievance of the petitioner is that the compromise which has been entered into before the Lok Adalat is without the consent of the petitioner inasmuch as the petitioner has not signed the order sheet maintained by the Lok Adalat. 4. A perusal of the papers indicates that a compromise joint petition has been filed by all the parties to the litigation. The petitioner, who was defendant No.10, has signed the compromise petition, which has been accepted by the Lok Adalat, and the Lok Adalat has categorically observed that the compromise joint petition filed by the parties has already been signed and identified by their respective counsel and it is in that background that the compromise petition was accepted. 5. Having signed the joint compromise petition, where the terms were agreed upon between the parties and

thereafter a decree had been drawn up, it is not available for the petitioner to challenge the same on the ground that he has not signed the order sheet. 6. The joint compromise petition is the one which encompasses and contains the terms of the settlement which have been arrived at, which admittedly has been signed by the petitioner who was defendant No.10 therein. Mere not signing of the order sheet will not take away the settlement which has been arrived at under the joint compromise petition. No grounds having been made out, the petition is dismissed. 7.
If at all the petitioner has any other grievance against the respondents which is not covered under the compromise petition, the petitioner is at liberty to file such proceedings as may be advised. Sd/- (SURAJ GOVINDARAJ) JUDGE
