1. The victim along with her father appeared virtually and recorded ‘no objection’ whereas, her father recorded ‘objection’ in granting bail to the applicants. 2. The applicants have preferred this 1st bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 292/2025, registered at Police Station – Lailunga, District- Raigarh (C.G.) for offence punishable under Sections 70(2), 61(2)(A), 115(2)of BNS and Section 6 of the POCSO Act, 2012. 3. In this case there are total 4 accused persons. 2 other accused to to commit rape on minor victim and in furtherance of conspiracy, the co-accused took the victim’s companion away from the victim and assaulted him. During this time, the applicant and other accused committed gang-rape on her. Based on above, offence has been registered against the applicants and they were arrested on
08.11.2025. 4. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the crime in question. Further, the test identification parade in which the victim identified the accused persons was vitiated. The other co-accused Vikas Kumar Bhagat has already been granted bail by this Court. The applicants are in jail since 08.11.2025, out of 24 prosecution witnesses, only 7 have been examined till date and the trial is likely to take time to be finalized, therefore, it is prayed that the applicants may be enlarged on bail. 5. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that at the time of incident, the victim was minor and she supported the case of prosecution.
The co- accused Vikas Kumar Bhagat has been granted bail by this Court as the victim has not identified him in her Court statement, in the instant case, the victim has duly identified the applicants in her Court statement. Hence, looking to the nature of offence, the applicants may not be released on bail. 6. I have heard learned Counsel appearing for the parties and perused the material available on record. 7. Considering the facts and circumstances of the case, the evidence collected by the prosecution against the applicants and further considering the fact that the case of the applicants is different from co- accused Vikas Kumar Bhagat, without commenting on the merits of the case, I am not inclined to release the applicants on bail. 8.
