3.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case.
Learned counsel also submits that in this matter, 202 kilograms and 815 grams of 'poppy husk' has been recovered in the intervening night of 18.09.2023 and 19.09.2023 from an 'Innova Crysta 2.4G', without number plate. Learned counsel contends that no one was found with the recovered contraband, however, subsequently on the basis of registration number of the vehicle, the owner of the vehicle-Pradeep Singh was interrogated and only on the basis of his statements, the present accused-applicant has been charged for the offence punishable under Section 8/29 of the Act of 1985. Learned counsel further contends that allegation against the present accused–applicant is that he was going to escort the alleged vehicle on a motorcycle; however, such escort did not take place, and the contraband in question was recovered by the police authorities.
4.
Learned counsel for the accused-applicant argues that no other criminal case has been registered against the present accused-applicant and during trial, the evidence of Seizure Officer has been recorded as PW-1 and no allegation has been found to be proved against the present accused-applicant. Learned counsel also argues that the accused-applicant was arrested on 12.11.2024 and since then, he is behind the bars and the trial is likely to take long time to conclude, therefore, the accused- applicant be granted benefit of bail.
5. Learned Deputy Government Advocate appearing on behalf of the State vehemently opposes this second bail application and
[2026:RJ-JP:1610] (3 of 3) [CRLMB-12922/2025] submits the factual report dated 08.01.2026. The said factual report is taken on record.
6. Heard learned counsel for the parties and also perused the material available on record.
7. Considering the overall facts and circumstances of the case, the period of custody of the accused-applicant; the fact that during trial, the statements of Seizure Officer has already been recorded; the fact that no recovery has been made from the accused-applicant and he has been charged with the offence punishable under Section 8/29 of the Act of 1985 only on the basis of statements of owner-Pradeep Singh and the trial is likely to take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow this second bail application filed on behalf of the accused- applicant.
8. Consequently, this second bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused-applicant Karandeep Singh @ Karn Singh S/o Dilbag Singh, arrested in connection with FIR No.242/2023, registered at Police Station Sangod, District Kota (Rural) shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the trial Court. Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
