1. The present Petition, filed under Articles 226 and 227 of the Constitution of India, seeks quashing and setting aside of the
Judgment dated 17.07.2026 [“Impugned Judgement”] passed by the learned Principal District & Sessions Judge, New Delhi District, Patiala House Courts, New Delhi in the matter, being PPA No. 16/2025, titled “M/s Bhim Sain Banwari Lal (P) Ltd. v. New Delhi Municipal Council”.

Learned counsel submits that, in view of the directions contained in Paragraph No. 42 of the Impugned Judgment, the matter This is a digitally signed order. would now receive de novo consideration before the Estate Officer and, accordingly, the Petitioner does not seek to pursue the present Petition.

Learned counsel appearing on behalf of the Petitioner, accordingly, on instructions, seeks the leave of this Court to withdraw the present Petition.
4. This Court has considered the aforesaid submissions. A perusal of Paragraph No. 42 of the Impugned Judgment makes it clear that the Estate Officer’s Order has been set aside and the matter has been
directed to be considered afresh by the Estate Officer, after affording adequate opportunity to all concerned parties and upon consideration of the relevant material.
5. In view of the aforesaid directions, no further Orders are called for in the present proceedings. Accordingly, the leave, as sought for, is granted.
6. The present Petition is, therefore, dismissed as withdrawn. The present Petition, along with pending Application(s), if any, stands
disposed of in aforementioned terms.
