HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 29/01/2026
1. Apprehending his arrest in connection with FIR No. 190/2024 registered at Police Station Sez, District Jaipur (West) for the offence(s) under Sections 420, 406, 467, 468, 471 and 120-B of IPC, the accused-petitioner has preferred this anticipatory bail application under Section 482 of BNSS.
2.
Learned counsel for the accused-petitioner submits that accused-petitioner has falsely been implicated in the case. He further submits that in the FIR, the name of petitioner is not mentioned. It is alleged against the co-accused- Asha Kumari that she forged the sale deed by showing herself as the owner of the plot. The accused-petitioner is not the beneficiary rather the other co-accused Asha Kumari is the main beneficiary. It is also contended that there is no substantive evidence available on record indicating the fact that the petitioner in connivance with co-
[2026:RJ-JP:4037] (2 of 3) [CRLMB-13619/2025] accused- Asha Kumari executed the forged sale deed. The accused-petitioner is ready and willing to cooperate with the investigation, custodial interrogation of the accused-petitioner is not required and apart from the cases under Sections 279 and 336 of IPC, there are no criminal cases against the petitioner, therefore, the anticipatory bail of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the anticipatory bail application and contended that the petitioner along with the other co-accused Asha Kumari forged the sale deed and got the property transferred in the name of Asha Kumari. The petitioner received Rs.40,000/- through Babulal Choudhary and Sanjay Meena, therefore, the anticipatory bail application of the accused-petitioner may be dismissed. 4. Heard and perused the factual report. 5. Considering the fact that the main allegation of forging the sale deed is against co-accused Asha Kumari and not against the present petitioner, therefore, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6.
Accordingly, the anticipatory bail application under Section 482 of BNSS is allowed and it is ordered that in the event of arrest of the petitioner Kanhaiyalal S/o Shri Ramulal, in connection with FIR No. 190/2024 registered at Police Station Sez, District Jaipur (West), he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the
