The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No.512/2017 dated 19th June, 2017, registered at P.S. Samaypur Badli, District Rohini under Sections 498-A/406/323/34 of IPC and all proceedings arising therefrom, on the ground of settlement. This is a digitally signed order. The petitioner no.1 is the husband of the respondent no.2 and the petitioners no.2, 3, 4 and 5 are the family members of the petitioner no.1. The marriage of the petitioner no.1 and the respondent no.2 was solemnised on 23rd April, 2015 as per Hindu rites and ceremonies. Marital disputes arose between the petitioner no.1 and the respondent no.2, which resulted in the filing of the present FIR on 19th June, 2017. 4. Now, the parties have settled their disputes in terms of the Settlement Agreement dated 23rd July, 2024, executed before the Mediation Centre, Rohini District Courts, Delhi, which has been placed on record as Annexure P-4 to the petition. In terms of the settlement, the parties have resolved their disputes and the parties have started residing together. 5. In terms of the settlement, a total amount of Rs.8,10,000/- was payable by the petitioners to the respondent no.2 out of which Rs.5,10,000/- has already been paid. The balance amount of Rs.3,00,000/- has been handed over by way of a demand draft in Court today. 6. Counsel for the petitioners, on instructions from petitioners who are present in Court, submits that the aforesaid demand draft shall be honoured upon presentation. 7. Issue Notice. 8. Notice is accepted by the APP appearing on behalf of the respondent no.1/State and the counsel appearing on behalf of the respondent no.2. 9. The respondent no.2 is present in Court and has been identified by her counsel as well as by the Investigating Officer (‘IO’). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the present FIR. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties. 11. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would be an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto. 12. Consequently, the FIR No.690/2023 dated 18th October, 2023, registered at P.S.
