The appellant has preferred this appeal against the judgment of acquittal dated 16.04.2018 passed in CC No.346/2016 by the Additional Senior Civil Judge and JMFC, Sagar. The Learned Magistrate has acquitted the accused for the commission of offence punishable under Sections 341, 324, 504 and 506 of IPC. The offence under Section 324 of IPC is cognizable and non-bailable in nature. Therefore, in view of Sub-section a(2) of Section 378 of Code of Criminal Procedure, 1973, the Court of Sessions is having jurisdiction to entertain the appeal. Hence, the matter requires to be transferred to the Court of Prl. District and Sessions Judge, Shivamogga along with Trial Court Records, accordingly transferred.
