03/ 03.07.2026 This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offence punishable under Section(s) 319(2), 318(4), 338, 336(3), 340(2) & 61(2) of BNS, 2023 and under Section(s) 66(B), 66(C), 66(D) & 84( C) of the Information Technology Act in connection with Deoghar (Cyber) P.S. Case No. 175 of 2025, pending in the Court of learned Additional Sessions Judge-II- cum- Special Judge, Cyber Crime Cases, Deoghar.
2. Heard, learned counsel for the parties and have gone through the impugned order.
3. Learned Spl. P.P opposes the prayer for bail of the petitioner.
4. Earlier the prayer for bail of the petitioner was rejected on 23.03.2026 in B.A. No. 2259 of 2026. The investigation of this case is complete. From the case diary, it transpires that from the mobile having I.M.E.I No. 861269058078428 seized form the petitioner, on the pretext of receiving grant of government, Rs.999/- has been cheated from the complainant, which was confirmed by the Call Details Report (CDR).
5. Considering the aforesaid fact, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner, named above, stands rejected. Accordingly, this bail application is dismissed.
6. The trial should be concluded within six months.
