Sanjoy Piprawall, Prince Kumar, Jay Prakash, Advocates -- 02/01.07.2026 The instant writ petition has been preferred by the petitioner for the following reliefs: a) For issuance of a writ of Mandamus directing Respondent No. 5, the Jharkhand Staff Selection Commission, to consider the candidature of the petitioner for appointment to the post of Sahayak Acharya (Class I to V) under the Non Para Teacher category and to direct the said respondent to consider the petitioner's eligibility under the provisions of Clause 19(iii) of Advertisement No. 13/2023, which stipulates that unreserved category candidates shall be treated as eligible for consideration against reserved category seats, particularly in light of the fact that the petitioner has secured 164.20 marks, which exceeds the qualifying marks (160.35) of the last selected. candidate in the unreserved category." b) Further direct the respondent to appoint the petitioner and issue the appointment letter in favour of the petitioner forthwith to the post of Sahayak Acharya 2026:JHHC:19479 2 (Class I to V), under the Non Para Teacher category under unreserved category in accordance with law. c) For issuance of an appropriate writ(s), order (s), direction (s) or a writ in the nature of Mandamus direct the respondent no 5 to take decision of the representation dated 09-12-2025 and 18-02-2026 (Annexure-9 and 9/A) filed by the petitioner before respondent no.5 i.e. Controller of Examination, Jharkhand Staff Selection Commission. d) During the pendency of this writ petition, 01 seat may be kept reserved in the name of the petitioner till the disposal of the writ petition. e) For issuance of an appropriate writ(s), order (s), direction (s) or a writ in the nature of Mandamus direct the respondent no 5 to take decision of the reply/application dated 01-09-2025 filed by the petitioner before respondent no.5 i.e. Controller of Examination, Jharkhand Staff Selection Commission. 2. Learned counsel for the petitioner submits that the instant application may be disposed of by granting liberty to the petitioner to approach the Controller of Examination, JSSC (Respondent no. 5), to consider his grievance. 3. Learned counsel for the respective respondents submits that since no counter affidavit has been filed; accordingly, the petitioner, if so chooses, he may approach the Controller of Examination, JSSC-Respondent no.5. 4. Having regard to the above, the instant writ application stands disposed of by granting liberty to the petitioner to approach the Controller of Examination, JSSC-Respondent no. 5 by filing fresh representation within a period of 4 weeks. Needless to say, if the petitioner approaches 2026:JHHC:19479 3 the Controller of Examination, JSSC-Respondent no. 5, he shall verify the records of the case and consider his representation within a period of 12 weeks from the date of receipt of such representation. It goes without saying that if the claim of the petitioner is found genuine, necessary order be passed. 5. With the aforesaid observations/direction, the instant writ application stands disposed of.
