JUSTICE DR. ANSHUMAN ORAL ORDER 2 17-06-2026 Heard Learned Counsel for the petitioners and Learned APP for the State. 2. The petitioners are apprehending arrest in connection with Halsi P.S. Case No.03 of 2026 lodged on 04- 01-2026, for the offences punishable under Sections 126(1), 115(1), 352, 329,(4), 74, 303(2), 351(2), 109(1), 3(5) of the B.N.S., 2023. 3. As per the prosecution, FIR has been lodged against 9 named accused persons including the present petitioners with allegation that they have entered into the house of the informant and assaulted by iron rod to her family members due to which Patna High Court CR. MISC. No.37989 of 2026(2) dt.17-06-2026 2/3 injury has been caused. Further allegation of snatching Mangalsutra worth Rs.30,000/- and cash Rs.1300/- are also there. 4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that both are residents of the same locality and they are basically neighbourer, residing in the same lane. He further submits that the informants’ side basically used to keep their cow in the lane, which was opposed by the petitioners’ side. It is due to this reason scuffling take place between both the parties. He further submits that for the same date and place of event, there is case and counter-case between the parties. Halsi P.S Case No.02 0f 2026 has been lodged by the petitioners’ side and Halsi P.S Case No.03 of 2026 has been lodged by the informant’s side. 5. Counsel submits that the criminal antecedent of the petitioners is clean and there is no specific allegation of assault against the petitioners. 6. Learned APP for the State opposes the prayer for bail of the petitioners, but fairly submits that from the FIR lodged by the petitioners’ side, the dispute is due to keeping cow in the lane. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M-1, Class, Lakhisarai in connection with Halsi P.S.
