No.5104 of 2026 ORDER This writ petition has been filed seeking a writ of mandamus to direct the first respondent to appoint the petitioner as qualified teacher in PG TRB examination conducted on 12.10.2025 and in terms of the result published on 27/11/2025 by considering the petitioner's representation rated 11.02.2025. 2.The case of the petitioner is that she participated in the recruitment process pursuant to the Notification issued by the second respondent vide Notification No. 2 of 2025 dated 10.07.2025 and became qualified. But the petitioner was not issued with any appointment order. According to the learned counsel for the petitioner, though there are number of vacancies available in the post of PG Assistant, the respondents instead of filling up the posts on permanent basis by duly appointing the eligible candidates like the petitioner, they are appointing the teachers on temporary basis thereby educational standard is being reduced. In other words, it is the contention of the petitioner that the respondents should select all the eligible candidates and fill up all the 2/6 https://www.mhc.tn.gov.in/judis WP(MD). No.5104 of 2026 vacancies available in the State notwithstanding the number of vacancies that are notified. 3. In response to the notice issued by this court, the respondents filed a counter affidavit contending that the petitioner has applied for the post of PG Assistant (English) and appeared for the examination and secured 76 marks under MBC/DNC category and the cut-off mark that is prescribed for MBC/DNC category is 99 and therefore, the petitioner could not be selected. In other words, it is the case of the respondents that the petitioner has not come up within the zone of consideration for being selected as PG Assistant (English). 4. There is no dispute on the mark secured by the petitioner and also with regard to the cut-off mark prescribed for MBC/DNC category. Admittedly, the petitioner failed to secure the minimum cut-off mark prescribed by the respondents. In the absence of securing the minimum cut-off mark, the question of the petitioner being appointed for the post of PG Assistant (English) in response to the Notification No. 2 of 25 does not arise. No.5104 of 2026 petitioner contending that the petitioner is required to be appointed in future as she was already found to be eligible for being appointed to the post of PG Assistant (English) is concerned, this Court is unable to accept the said contention as the respondent Board is only conferred with power and jurisdiction to notify the vacancies that are notified to the respondent Board and select the candidates in respect of the said posts only. It is not the case of the petitioner that the respondent Board failed to select the candidates in respect to the posts that are notified in the Notification in question. Therefore, the relief sought in the present position cannot be granted and the relief sought itself is totally misconceived. 5. Accordingly, this writ petition is dismissed. However, it is made clear that in case if any further new notifications are issued in future, petitioner is at liberty to participate in recruitment process on par with other eligible candidates.
