Heard learned counsel for the parties.

The instant writ application has been preferred by the petitioner praying therein for the following reliefs: i. For issuance of an appropriate writ/order/direction including a writ in the nature of Mandamus commanding upon the respondents to keep in abeyance/stay further proceedings pursuant to Charge Sheet No. PO/Syl- D/(BS)/Charge Sheet/Sri Ramesh Yadav/2025 dated 23.10.2025 till conclusion of the criminal prosecution arising out of RC No. RC- 0242025A0004. ii. For issuance of an appropriate writ/order/direction restraining the respondents from proceeding further with the departmental enquiry and from passing any final order therein during pendency of the criminal case. iii. For issuance of an interim order that during pendency of the present writ petition, further proceedings before the Enquiry Officer including recording of evidence and submission of enquiry report be stayed in the departmental enquiry. iv. For issuance of a writ of Mandamus directing respondent no. 4 to decide the petitioner's representation dated 30.05.2026 (Annexure.J) before proceeding further in the disciplinary proceeding.

At the outset, learned counsel for the petitioner submits that the instant writ application may be disposed of by directing the concerned respondent to dispose of the representation dated 30.05.2026.

Learned counsel for the respondents fairly submits that since no counter affidavit has been filed; as such the petitioner may be directed to approach the concerned respondent by filing a fresh representation, who shall look into the matter so that the grievance of the petitioner can be redressed.

Having regard to the aforesaid submissions and without going into the merits of the case, the instant writ application is hereby disposed of by directing the respondent No.4 to look into the grievance of the petitioner by treating this writ application as representation and take a decision in the matter in accordance with law and applicable rules and regulations by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of copy of this order and communicate the same to the petitioner.

The petitioner shall serve a copy of this writ application along with the relevant documents to the concerned respondent for convenience.

With the aforesaid observations and directions, the instant writ application stands disposed of. Pending I.A., if any, also stands closed.
