By this petition under Section 407 of the Code of Criminal Procedure, 1973 [“CrPC”], the Petitioner seeks transfer of Maintenance Petition No. 314/2024, instituted under Section 125 of the CrPC, from the Court of the Principal Judge, Family Court, District East, Karkardooma Courts, Delhi, to the Court of the Principal Judge, Family Court, District Shahdara, Karkardooma Courts, Delhi. 2. Counsel for the Respondent states that he wishes to file a reply. He submits that the Respondent had already raised an objection before the Family Court regarding the lack of territorial jurisdiction. He, therefore, submits that, instead of transferring the Maintenance Petition to the Principal Judge, Family Court, District Shahdara, the Maintenance Petition ought to be dismissed for want of territorial jurisdiction. 3. The Petitioner has herself stated that the last matrimonial residence of the parties falls within the jurisdiction of P.S. Madhu Vihar, District Shahdara, and that the Maintenance Petition was filed before the District East Family Court inadvertently. The report of the Filing Counter, as recorded in the order dated 8th October, 2025 passed by the Family Court, also states that the matrimonial residence falls within P.S. Madhu Vihar, District Shahdara. The Family Court, in view of the said report, recorded that the Maintenance Petition was not maintainable before it and directed the Petitioner to take steps for transfer of the petition to the concerned district. 4. In view of the above, the present petition is allowed. Maintenance Petition No. 314/2024, titled Shweta Dev v. Rohit Verma, presently pending before the Court of the Principal Judge, Family Court, District East, Karkardooma Courts, Delhi, shall stand transferred to the Court of the Principal Judge, Family Court, District Shahdara, Karkardooma Courts, Delhi. 5.
