This petition by the defendants in O.S.No.302/2023 is directed against the impugned order dated 24.01.2026 passed in M.A.No.31/2024 - 3 - HC-KAR NC: 2026:KHC:10819 WP No. 5963 of 2026 whereby, the First Appellate Court allowed the appeal filed by the respondent-appellant thereby, setting aside the order of temporary injunction passed in favour of the petitioners by the trial Court. 2. Though several contentions have been urged by both sides in support of their respective claims, having regard to the fact that there are several contentious issues and disputed questions of law and fact that arises for consideration in the suit before the trial Court which would necessarily have to be adjudicated upon only after a full-fledged trial, and without expressing any opinion on the merits/demerits of the rival contentions, I deem it appropriate to dispose of this petition directing the trial Court to dispose of the suit on merits and in accordance with law without being influenced by the findings and observations recorded in the order of the trial Court and the impugned order passed by the First Appellate Court. 3.
