ORDER IN M.A.NO.31/2024 DATED 24.01.2026 PASSED BY THE SENIOR CIVIL JUDGE AND JMFC AT ARAKALAGUDU (ANNEXURE-A) ON I.A.NO.1, FILED U/O.39 RULE 1 AND 2 OF CPC., IN THE INTEREST OF JUSTICE AND EQUITY.

ORAL ORDER
1. This petition by the defendants in O.S.No.302/2023 is directed against the impugned order dated 24.01.2026 passed in M.A.No.31/2024

whereby, the First Appellate Court allowed the appeal filed by the respondent-appellant thereby, setting aside the order of temporary injunction passed in favour of the petitioners by the trial Court.
2. Though several contentions have been urged by both sides in support of their respective claims, having regard to the fact that there are several contentious issues and disputed questions of law and fact that arises for consideration in the suit before the trial Court which would necessarily have to be adjudicated upon only after a full-fledged trial, and without expressing any opinion on the merits/demerits of the rival
contentions, I deem it appropriate to dispose of this petition directing the trial Court to dispose of the suit on merits and in accordance with law without being influenced by the findings and observations recorded in the
order of the trial Court and the impugned order passed by the First Appellate Court.
3. It is further directed that without prejudice to the rights and
contentions of the parties, both parties shall maintain status quo in all respects as on today and in relation to the suit schedule property till disposal of the suit.

4. All rival contentions and all aspects of the matter are kept open and no opinion is expressed on the merits/demerits of the rival
contentions of the parties.
