Tiwari, Spl.P.P …...... 02 /03.07.2026: The petitioner, who is an accused for the offence punishable under Sections 319(2)/3(5), 318(4)/3(5), 338/3(5), 336 (3)/3(5), 340(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Section 66(B), 66 (C), 66(D) &84(C) of the IT Act, is praying for grant of regular bail. 2. Heard the learned counsel for the petitioner and I have gone through the entire record including the impugned order. 3. Learned counsel for the State opposes the prayer for bail. 4. Earlier the prayer for bail of the petitioner was rejected on 11.03.2026. From the paragraph nos. 59 & 65 of the case diary, it appears that a Blue colour Redmi Android Mobile having IMEI No. 866487076026824 was recovered from the possession of this petitioner and from the said mobile, he called the victim showing himself as a PhonePe customer care official, siphoned a sum of Rs. 1661/- from victim. 5. Considering the aforesaid fact, I am not inclined to allow this application. Accordingly, the prayer for bail of the petitioner in connection with Cyber Crime Case No. 33 of 2026, arising out of Deoghar (Cyber) P.S. Case No. 163 of 2025, pending in the court of Additional Sessions Judge-II- cum-Special Judge, Cyber Crime cases, Deoghar stands rejected. 6. Accordingly, the instant bail application stands dismissed. 7. Trial court is directed to conclude the trial within a period of six months from the receipt of copy of this order.
