Order 13/01/2026
1. These bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.391/2023 registered at Police Station Nagar, District Deeg for offences punishable under Sections 323, 341 and 382 of IPC. After completion of investigation, police filed
[2026:RJ-JP:1489] (2 of 4) [CRLMB-12882/2025] charge-sheet in this matter for the offences punishable under Sections 323, 341, 304 and 34 of IPC.
2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case.
Learned counsel submit that there is no eye witness of the incident. Counsel submit that deceased was found lying on the road in unconscious condition on 10.09.2023 and thereafter, he was admitted in the hospital. Counsel submit that FIR was lodged after two days on 12.09.2023 alleging that on 09.09.2023 deceased Jaihind went along with petitioner – Deepak on a motorcycle to receive money of Rs.5 lakhs from his uncle and the petitioner Deepak gave information to other co-accused persons and thereafter, with the intention to rob the deceased, the petitioners and other co-accused brutally beat up the deceased. They argue that deceased died on 04.12.2023 and according to the post-mortem report cause of death is septicemic shock and possibility cannot be ruled out that on account of medical negligence death was occurred. They further argue that police completed the investigation and charge-sheet has been filed for the offences punishable under Sections 323, 341, 304 and 34 of IPC and no offence under Section 302 of IPC was found in the investigation. They argue that trial of the case will take considerable time in its conclusion. They further contend that the petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose.
[2026:RJ-JP:1489] (3 of 4) [CRLMB-12882/2025]
3. Learned Public Prosecutor opposes the submissions made by the learned counsel for the petitioners. Investigating Officer of this is present in person, under his instruction, learned Public Prosecutor submits that according to the investigation, offences punishable under Sections 323, 341, 304 and 34 of IPC were found and charge-sheet was filed. He further submits that charges were framed for the offences punishable under Sections 323, 341, 304 and 34 of IPC.
4. I have considered the contentions.
5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially considering the material available on record in the form of charge-sheet and trial will take time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it proper to allow these bail applications.
6. These bail applications are accordingly allowed and it is
directed that accused-petitioners- (1). Deepak @ Deependra S/ o Mordwaj, (2). Anil @ Amit S/o Motisingh, and (3). Mukesh S/o Balram shall be released on bail provided, each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh Only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is
[2026:RJ-JP:1489] (4 of 4) [CRLMB-12882/2025] transferred, on all subsequent dates of hearing and as and when called upon to do so.
7. The observations made hereinabove are only for decision of these bail applications and would not have any impact on the trial of the case in any manner.
