The Petitioner has approached this Court for grant of regular bail in connection with Spt. S.T.Case No. 69/2009 arising out of Palkot P.S. Case No. 69/2008 (G.R. Case No. 887/2008), registered for the offence under Sections 302/201/341/34/379 of I.P.C and cognizance was taken under Sections 302, 201,34,341 & 379 of I.P.C 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner has been apprehended on the basis of statement of one eye witness, Urmila Devi and the said Urmila Devi has been examined by the trial court and she has been declared hostile. He further submits that the petitioner is languishing in custody since 25.02.2025; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court. 4. Learned A.P.P opposes the prayer for bail of the Petitioner. 5. Having regard to the allegation made against this petitioner, coupled with the fact that the petitioner’s name has surfaced on the basis of statement of Urmila Devi, who has been declared hostile and also the fact that the petitioner is languishing in custody since 25.02.2025; 2026:JHHC:7134 2 I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Gumla, in connection with Spt. S.T.Case No. 69/2009 arising out of Palkot P.S. Case No. 69/2008 (G.R. Case No. 887/2008. 6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
