This is the 9rst bail application 9led under Section 483 of the Bhartiya Nagrik Suraksha Sahita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 03/2026 registered at Police Station Bodhghat, Jagdalpur, District Bastar (C.G.), for the o<ence punishable under Sections 15(b) and Section 18(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief, is that the Assistant Sub-Inspector of Police Station Bodhghat, Bastar, on the basis of a secret tip received from an informer, seized 15.006 kg of poppy straw and 323 grams of ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.04.08 11:17:48 +0530 2 opium from a black bag which was in the appellant’s possession. Thereafter, upon completion of the investigation, the police 9led the charge sheet on 28.01.2026. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He submits that the mandatory provisions with regard to search and seizure were not complied with in this case. He further submits that the applicant is in jail since 03.01.2026, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned State counsel opposes the bail application and submits that the charge-sheet has already been 9led before the competent Court. She further submits that the present applicant has one criminal antecedent under the NDPS Act of a similar nature, in which the applicant has already been convicted. Therefore, in view of the aforesaid antecedent, it is submitted that the applicant does not deserve to be enlarged on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having heard the learned counsel for the parties and upon perusal of the case diary as well as the material available on record, this Court 9nds that the charge-sheet has already been 9led before the competent Court. It is further revealed that the applicant has one criminal antecedent under the NDPS Act of a similar nature, in which he has already been convicted. Considering the nature and gravity of the o<ence, coupled with the aforesaid antecedent of the applicant, this Court is not inclined to grant bail. 7. Accordingly, the bail application of the applicant – Manish Chandak, 3 involved in Crime No. 03/2026 registered at Police Station Bodhghat, Jagdalpur, District Bastar (C.G.), for the o<ence punishable under Sections 15(b) and Section 18(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
