Learned counsel for the petitioner submits that there is an interim relief in favour of the petitioner, whereby the finding of the First Appellate Court regarding sale deed Exhibit P-2 dated 23.04.1988 has been stayed. 2 are raising construction over the land in question and, since the interim order staying the finding of learned First Appellate court is continuing in favour of the petitioner, the act of the respondents in raising construction over the property in question amounts to contempt of the interim order passed by this Court.
2. Heard learned counsel for the petitioner and perused the record.
3. Perusal of the order dated 27.06.2024 reveals that only the finding recorded by the learned First Appellate Court regarding the validity of the sale deed has been stayed. However, learned counsel for the petitioner failed to point out any order of injunction passed by this Court in S.A. No. 302 of 2024 restraining the respondents from raising construction over the property in question. Hence, in absence of any injunction order operating against the respondents, it cannot be said that the respondents have violated any order passed by this Court.
4. In view of the above, no case of contempt is made out against the respondents.
5. Accordingly, the present contempt petition is dismissed. Sd/-
