04/16.03.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Complaint Case No.1583/2019, registered for the offence under Section 33(i)(c) of Indian Forest Act, 1927, pending in the Court of the learned Chief Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioners submits that false allegations are made against the petitioners of cultivation of poppy plants on the forest land. He further submits that even the land is not belonging to the petitioners. He next submits that the petitioners are having no criminal antecedents, as disclosed in paragraph 10 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plants on the forest land.

Considering that the land is of the Forest Department and that is not belonging to the petitioners and the petitioners are having no criminal antecedents, as disclosed in paragraph 10 of this application and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper.
6. Accordingly, this application is disposed of.
