CMP(M) No.438 of 2026 Delay of 32 days in filing the present appeal is condoned in view of the averments made in the application duly supported by an affidavit. The application stands disposed of. RFA N o.______of 2026 It be registered. Inter alia contends that the land in question was acquired in Village Nangal Uperla, for the purpose of construction of ‘Pinjore-Baddi-Nalagarh-Swarghat’ National Highway and the notification under Section 4(1) of the Land Acquisition Act, 1894 was issued on 25.07.2013. The award was passed on 18.01.2016 by the Land Acquisition Collector. The market value of the petitioner’s land was determined at the rate of Rs.11,00,000/- per Bigha on the basis of circle rates approved by the District Collector, Solan. The Reference Court has enhanced the compensation amount to Rs.35,16,250/- per Bigha on the basis of the average of four sale deeds, which is clear from Paragraphs-25 and 26 of the judgment dated 10.09.2025, passed by the learned Land Acquisition, Rehabilitation and Resettlement Authority (Additional District Judge), Nalagarh, District Solan, H.P. It is accordingly pointed out that three sale deeds pertain to village Dattowal and one of such land has also a constructed house on this. It is thus contended that Dattowal is better situated at a considerable distance from Village Nangal Uperla and the value, as such, could be reduced if one has to proceed from Nalagarh to Swarghat as the commercial area is more towards Nalagarh. It is thus contended that the enhancement, as such, requires consideration. Admit. In the meanwhile, State shall deposit the compensation amount at the rate of Rs.20,00,000/- per Bigha, within a period of three months from today. (G.S. Sandhawalia) Chief Justice ( Bipin C.
