1. This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”] read with Article 227 of the Constitution of India assails the impugned order dated 13th May, 2026 passed by ASJ-07, Patiala House Courts, New Delhi in Criminal Revision No. 575/2024, whereby the summoning order passed by JMFC-04, Patiala House Courts, New Delhi, was upheld.
2. Subsequent to the aforesaid order, further developments have taken place. On 8th June, 2026, the Trial Court passed an order observing that sufficient material was available on record to frame charges against the accused and that the grounds raised in the discharge application would be considered after recording of evidence. The Petitioner has accordingly been held liable to be charged under Sections 506/34 Indian Penal Code, 1860 This is a digitally signed order. In view of the aforesaid development, counsel for the Petitioner, after addressing submissions for some time, seeks leave to withdraw the present petition, with liberty to raise all the grounds urged herein while challenging the order on charge. Leave and liberty, as prayed for, are granted. The Court has not expressed any opinion on the merits of the case. All rights and
contentions of the parties are left open.
4. It may also be noted that a similar petition filed by the co-accused, Mukesh Kumar Choudhary, was disposed of with similar observations by this Court vide order dated 18th August, 2026 in CRL.M.C. 6034/2026.
5. The petition is disposed of as withdrawn with liberty as aforesaid. The pending applications shall also stand disposed of.
