The petitioner has filed this petition for enhancement of compensation as his land has been acquired for widening of National Highways (Champa-korba- Churi-Kathora) of National Highway No. 149(B), Tahsil Korba at village Panda District Korba. 2. Counsel for the petitioner would submit that the Land Acquisition Officer while assessing the compensation has not paid less compensation towards Building, boundary wall, sewerage system, bore well, water tank and would pray for quashing of the order dated 05.08.2022. 3. On the other hand, learned counsel for the respondent would submit that the writ petition is not maintainable in view of the alternate and efficacious remedy is available to the petitioner raising the dispute before the Arbitrator appointed under Section 3G (5) of the Act and would pray for dismissal of the writ petition. 4. I have heard learned counsel for the parties and perused the record. 5. Since the petitioner has alternate and efficacious remedy of raising the dispute before the Arbitrator/Commissioner, Bilaspur Division as the Government of India has issued notification appointing the Commissioner, Bilaspur as Arbitrator for Korba District also, therefore, the writ petition is not maintainable and is disposed of.
In the eventuality of filing of dispute within 45 from the date of receipt of copy of this order, the Commissioner will not take plea of limitation as this Court has condoned the delay in preferring the dispute and will decide the dispute on its own merit. It is made clear that this Court has not commented anything on the merit of the contention raised by the petitioner. Sd/- (Narendra Kumar Vyas) Judge Santosh
