...RESPONDENT(S): Counsel for the Petitioner:

1. GP FOR REVENUE
3 BKM,J W.P.No.7168 of 2026
The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4. 2. The issuance of notices to the respondent Nos.5 to 21 is dispensed with as no prejudice would cause to them even if it is disposed of in their absence. 3. This writ petition is filed questioning the order of the 3rd respondent dated 07.02.2026 by allowing the appeal preferred by the unofficial respondents herein and cancelling the mutation entries made in favour of the petitioner herein/respondents therein with respect to the subject land in an extent of Ac.3.60 cents in Sy.No.1213 of Gannevaripalli Village, Tadipatri Mandal, Ananthapuramu District. 4.
The learned counsel for the petitioner submits that the 3rd respondent ought not to have entertained the appeal on the ground of lapse of limitation period and the 3rd respondent ought to have seen that the petitioner herein was given pattadar passbook and title deed and her name was duly mutated in the revenue records after conducting necessary enquiry by the Tahsildar and upon necessary proceedings addressed to the Joint Collector in this regard. 5. The learned counsel for the petitioner refers to the Form-V notice issued by the 4th respondent dated 16.02.2023 given to the unofficial respondents
4 BKM,J W.P.No.7168 of 2026
herein as they have not participated in the enquiry, further steps have been taken to mutate the name of the petitioner for the subject land. 6. He also further refers to the letter addressed by the Joint Collector, Ananthapuramu to the respondent Nos.3 and 4 herein dated 18.06.2023 to show that after long lapse of time, the 3rd respondent entertained the appeal at the instance of the unofficial respondents herein to interfere with the mutation process by ordering deletion of the name of the petitioner from the revenue records in the subject land to substitute the names of the unofficial respondents herein, which is not permissible under law. 7. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4 submits that the impugned order of the 3rd respondent dated 07.02.2026 can be challenged by way of revision before the Joint Collector, Ananthapuramu within a period of 30 days from the date of receipt of the said order. 8. In view of the above said facts and circumstances, since the petitioner herein has got an effective alternative remedy before the revisional authority to raise all the above said grounds, necessary permission is granted by this Court to avail the said opportunity.
Accordingly, the petitioner is permitted to file revision before the revisional authority/the Joint Collector, Ananthapuramu against the order of the 3rd respondent dated 07.02.2026, enclosing all the necessary documents in support of her claim within a period of four (04) weeks from the date of receipt of this order. On filing the said revision by the
5 BKM,J W.P.No.7168 of 2026
petitioner, the said revisional authority shall consider and dispose of the same strictly in accordance with law by hearing all the parties concerned, including the petitioner and the unofficial respondents herein/respondent Nos.5 to 21 and others concerned, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible preferably within a period of four (04) months thereafter. Pending the revision, there shall be an order of status quo as on today to be maintained with respect to the subject land in respect of the mutations. In default of filing the above said revision within the stipulated time as directed above, the interim protection granted by this Court stands automatically vacated. The petitioner is at liberty to raise all the grounds both on facts and law in the Revision. 9. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. __________________________ JUSTICE B. KRISHNA MOHAN
