Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for records relating to the impugned refusal check slip in E-Check slip 09/2026 dated 30.03.2026 and quash the same as illegal and consequently direct the respondent to register and release the settlement deed in pending Document No.TP/263699914 of 2026 presented by the petitioner. When the petitioner presented a sale deed, the same was refused to be registered on the ground that the patta is not in the name of the petitioner or her vendor. 3. The learned counsel for the petitioner would trace the title from one K.R.Venkatraman, who was the original owner of the property. The continuous sales from K.R.Venkatraman and thereafter from the next person and ultimately resulting in a Court auction sale and the further purchase by the petitioner's predecessor in title, are all detailed in the document itself. 4. In view thereof, it is evident that even in the order of the Revenue Divisional Officer referred to in the impugned order, it has been stated that the patta was ultimately ordered to be restored in the name of K.R.Venkatraman. When the petitioner traces title to the said K.R.Venkatraman through proper original deeds, and such original deeds have been produced, I am of the view 2/5 https://www.mhc.tn.gov.in/judis W.P.(MD)No.13236 of 2026 that the reasons mentioned in the impugned refusal check slip cannot be sustained. At the same time, when there is a rule that the parties have to produce patta, eternally sale after sale, the petitioner and her predecessor in title cannot remain non-compliant of the said rule. It is stated that the petitioner had already applied for mutation of Patta. Therefore, the document shall be registered, and the petitioner shall pursue the mutation proceedings and get the same mutated. 5. In view thereof, this writ petition is allowed on the following terms:- (i) The impugned refusal check slip, dated 30.03.2026, shall stand set aside and the matter is remanded back to the file of the respondent. (ii) Within two weeks from the date of receipt of a web copy of the order, the petitioner shall represent the document, along with the original documents through which he traces the title from the said K.R.Venkatraman. Upon consideration thereof, the document shall be registered, if there is no other impediment.
