Virender Singh, Judge (Oral) Petitioner–Udham   Singh   has   filed   the   present petition, under Article 227 of the Constitution of India, against the order dated 09.06.2026,   passed by  the learned District Judge, Kullu, District Kullu, in CMP No.153 of 2026, which was filed in Civil Suit No. 332 of 2023/2010, titled as Udham Singh versus Kuldass’. 2. Vide   order   dated   09.06.2026,   learned   District Judge, Kullu, has dismissed the application filed by petitioner 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:34150 Udham   Singh,   for   transfer   of   his   case   bearing   Civil   Suit No.332/2023/2010, pending before the Court of learned Senior Civil Judge, Lahaul & Spiti, at Keylong to the Court of learned Senior Civil Judge, Kullu or any other Civil Court at Kullu. 3. The said application has been dismissed by the learned District Judge, on the ground that the petitioner has not   approached   the   Police   for   redressal   of   his   grievances, when, he was allegedly threatened by the respondent, as well as, his henchman. The prayer has also been declined on the ground   that   no   allegations   of   biasness   have   been   alleged against   the   Court,   in   which,   the   proceedings,   are   being conducted. 4. Petitioner   has   filed   a   suit   for   recovery   of Rs.10,00,000/­,   in  the  Court   of  learned  Senior   Civil   Judge, Kullu, which was transferred to the Court of learned Senior Civil Judge, Lahaul and Spiti at Keylong. 5. The transfer of the said suit was sought by the petitioner, by filing the application, under Section 24 of the Code of Civil Procedure (hereinafter referred to as ‘the CPC’), before the learned District Judge, on the ground that he has 3 2026:HHC:34150 been   called   by   the   respondent   to   his   house,   where,   he misbeheaved with the petitioner and the petitioner has been threatened by the respondent. At that time, he was under the influence of liquor and one person was also with him. Due to the   compelling   circumstances,   the   petitioner   has   to   leave Keylong and while leaving, he has also left his tools, iron shuttering tools and other material, on the spot. Thereafter, he has gone back to his home at Chachiot, along with his workers. 6. On the basis of the above facts, the petitioner is apprehending that in case, he will attend the proceedings at Keylong, where, his case is being taken up, by the learned Senior Civil Judge, Lahaul and Spiti, some untoward incident could happen with him. 7. Perusal of the order passed by the learned District Judge   shows   that   even   notice   has   not   been   issued   to respondent Kuldass,  seeking  his version on the allegations levelled against him and the application has been dismissed. 8. Said order has been assailed, before this Court, by the petitioner. The respondent has put appearance through 4 2026:HHC:34150 Mr. Rohit Thakur, Advocate, who, although has controverted the   allegations,   which   have   been   levelled   against   the respondent,   however,   the   allegations   levelled   against   the respondent must be examined in the light of the principle that justice   must   not   only   be   done,   but,   must   also   manifestly appear to have been done. When, a person is apprehending that   some   untoward   incident   may   take   place,   in   case,   he attends the proceedings at Keylong, definitely, he would not be able to pursue his case effectively. As such, the Court must take due cognizance of this practical constraint. 9. Considering the said fact, the petition is allowed, order   dated   09.06.2026,   passed   by   learned   District   Judge, Kullu, is set aside and Civil Suit No.332/2023/2010, titled as Udham  Singh  versus  Kuldass,  pending  adjudication  in  the Court of learned Senior Civil Judge, Lahaul & Spiti at Keylong is ordered to be transferred to the Court of learned Senior Civil Judge, Manali, District Kullu. 10. Learned   Senior   Civil   Judge,   Manali,   District Kullu, H.P., is requested to proceed further, after securing the presence of both the parties. 5 2026:HHC:34150 11. A copy of this order be sent to the Court of learned Senior Civil Judge, Lahaul & Spiti at Keylong, as well as, to the   Court   of   learned   Senior   Civil   Judge,   Manali,   District Kullu, H.P., for compliance.
