This present writ petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “i. ISSUE RULE, calling upon the respondents, to show cause as to why a Writ of Certiorari and/or in the nature thereof, shall not be issued, calling for the records, lying with the respondents, for rendering substantial and conscionable justice to the petitioner; ii. ISSUE RULE, calling upon the respondents, to show cause as to why a Writ of Mandamus and/or in the nature thereof, directing the respondents to consider the case of the petitioner in the light of the communication dated 29.01.2025 and release the deposited Security amount in favour of the petitioner within a definite period, as may be determined by the Hon'ble High Court; iii. After hearing the parties, be pleased to make the Rules absolute in terms of Prayer i and ii above; iv. Costs of and incidental to this proceeding; v. Any other relief(s) as to this Hon'ble High Court may deem fit and proper; 2. Heard Mr. P. Biswas, learned counsel appearing for the petitioner as well as Ms. P. Chakraborty, learned counsel appearing for the respondents. 3. It is the case of the petitioner that he was awarded the licence for running the Kali Bazar FL Shop and, accordingly, after fulfilling all the terms and conditions, the petitioner started the FL shop. He was granted licence for the period from 31.03.2024 to 31.03.2025 and, according, he had furnished the Bank Guarantee in terms of the license tender conditions. He has also successfully completed the business during the said licence period and at present he is not carrying on any business. During the course of the licence period, while he was running into financial crisis, he made a request to adjust his last installment out of the Bank Guarantee furnished by him. Since the said request was not acceded to, he cleared the entire licence fee amount by 31.03.2025 and, according to the petitioner, there are no dues outstanding. 4. The petitioner thereafter made a request to the respondents for release of the said Bank Guarantee, however, the same is yet to be considered. The request made by the petitioner to that effect on 29.01.2025 is also pending till date before the respondents herein. 5. In view of the above, without expressing any opinion on the merits of the case, this Court directs the respondents to look into and consider the matter and, if there are no arrears, to release the said Bank Guarantee as early as possible, preferably within a period of one month from today. 6. With the above observation and direction, the present writ petition stands disposed of. As a sequel, interim order(s), if any, stand vacated. Pending application(s), if any, also stand closed. DR. T.
