Learned counsel for the petitioner submits that he does not have any claim or relief against respondents No.1 and 2 and as such he has filed a memo seeking for deletion of respondents No.1 and 2. Accepting the - 3 - HC-KAR NC: 2026:KHC:25408 WP No. 34115 of 2024 said memo, respondents No.1 and 2 are deleted from the array of parties. 2. Learned counsel for the petitioner is directed to carry out necessary endorsement in the cause title of the petition. 3. The petitioner is before this Court seeking for the following reliefs; a. To issue a writ of mandamus or any other direction or any writ by directing the Respondent No.1 and 5 to consider the representations dated 22.7.2020, 20.08.2020, 11/09//2020, 08/10/2020, 05.07.2022, 05.07.2022, 26.09.2022 and 21.11.2024 as per Annexure-A to A9; b. To pass such other order/s as deems fit by this Hon’ble Court in the interest of justice and equity. 4. The grievance of the petitioner is that, despite the petitioner having performed his obligation under the work order issued in pursuant to the tender notification dated 16.01.2017, the bills which have been raised by the petitioner have not been paid, nor has the Earnest Money Deposit (EMD) been returned. It is in that background that the petitioner is stated to have submitted various representations - 4 - HC-KAR NC: 2026:KHC:25408 WP No. 34115 of 2024 produced at Annexure-E, which have not been considered by respondents and for that reason the petitioner is before this Court seeking for the aforesaid reliefs. 5. Learned AGA on instruction submits that; 5.1. the petitioner has not made payment to the employees and there being claims raised by the said employees, the payment has not been paid, and it is for that reason that the amounts have not been paid to the petitioner. 5.2. She submits that, if ‘No Dues Certificates’ are obtained from the concerned employees, the bills of the petitioner would be processed. 6. Learned counsel for the petitioner submits that he may not be in a position to obtain the ‘No Due Certificate’. However, he would be able to place on record proof of payment made to all the employees. 7. In view of the said submission, reserving liberty to the petitioner to submit all the necessary documents - 5 - HC-KAR NC: 2026:KHC:25408 WP No. 34115 of 2024 to respondent No.4, which shall be so submitted by 06.07.2026, the above petition is disposed of directing respondent No.4 to consider the said document and pass necessary orders thereon within three weeks of the submission of the said documents. 8. It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner. Respondent No.4 would have to consider the entitlement on the basis of the terms and conditions of the tender document and the work order which has been issued.
