None appears on behalf of the applicant to press this application when the case is called out, however, with the assistance of the learned State counsel, this Court proceeds to hear and decide this bail application. 2. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 980/2024, registered at Police Station – Tikrapara, District- Raipur, (C.G.) for the offence punishable under Sections 296, 351(3), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023. 3. As per the prosecution case, the complainant lodged a complaint before PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.12 17:50:28 +0530 2 the concerned Police Station Tikrapara, District Raipur, alleging inter alia that, on the date of the incident, a minor dispute arose between the applicant and the complainant due to previous enmity, following which the applicant assaulted the complainant. As a result of the said incident, the complainant sustained simple injuries. On the basis of the complaint, the concerned police station conducted an investigation and registered a crime against the present applicant for offences punishable under Sections 296, 351(3), 109, and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 4. It has been pleaded in the bail application that the applicant is innocent and has been falsely implicated in this case and the applicant is in jail since 18.04.2025 and the applicant has no previous criminal antecedents. 5. The learned State counsel opposes the bail application and submits that the charge-sheet has already been filed before the competent Court in the present case. It transpires from the MLC report of the injured that he sustained a penetrating injury on his chest and had undergone surgery. It is further submitted that a knife has been seized from the possession of the present applicant. Learned State counsel further submits that the bail application of the co-accused, namely, Samir Qureshi, has already been rejected by this Court vide order dated 04.02.2026 passed in MCRC No. 1120/2026, hence, the present applicant is not entitled to be released on bail. 6. I have heard learned counsel for the State and perused all of the documents available on record. 7. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that it transpires from the MLC report of the injured that he sustained a penetrating injury on his chest and had undergone surgery, further a 3 knife has been seized from the possession of the present applicant, also considering the fact that the bail application of the co-accused, namely, Samir Qureshi, has already been rejected by this Court vide order dated 04.02.2026 passed in MCRC No. 1120/2026, this Court is of the view that the applicant is entitled to be granted regular bail in this case. 8. Accordingly, the second bail application of applicant – Aamir Husain @ Ammu involved in Crime No. 980/2024, registered at Police Station – Tikrapara, District- Raipur, (C.G.) for the offence punishable under Sections 296, 351(3), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
