sg 16.wp(c)13647-26.docx IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 13647 OF 2026 Amol Tukaram Bhoirkar … Petitioner versus The State of Maharashtra Through Principal Secretary And Ors. … Respondents ---- Mr. Venkatesh Shinde, for the Petitioner. Mr. Asif I. Patel, AGP, a/w. Mr. M.M. Pable, AGP, for the Respondent/State. ---- CORAM:BHARATI DANGRE & ASHISH S. CHAVAN, JJ. DATE: 12th OCTOBER, 2026 P.C.: 1. The revision application filed by a Co-operative Society and its Secretary before the Hon’ble Minister of Cooperation, Mumbai, is instituted on 6th October, 2026. The relief sought in the petition is for expeditious disposal of the revision application or, at least, the application for grant of stay. __________________________________________________ 12th October, 2026 SMITA JOHNSON GONSALVES Digitally signed by SMITA JOHNSON GONSALVES Date: 2026.10.14 17:21:06 +0530 sg 16.wp(c)13647-26.docx 2. We must only indicate that when the Hon’ble Minister is assigned the task of deciding certain proceedings, based upon the Rules of Business pertaining to the said Department, it is definitely the prerogative of the said Authority to decide the sequence and manner in which the proceedings shall be decided. It is certainly too optimistic for the Petitioner to expect that such a revision application shall be decided forthwith. We are conscious of the fact that many such proceedings are pending before the Authority. As the Authority has to deal with such proceedings, we have noted that it takes time to decide them. Therefore, we are not at all inclined to grant even the innocuous prayer, as, according to the learned Counsel for the Petitioner, he is only praying for expeditious disposal of the petition. In case the Petitioner has filed a stay application in the said revision, he can make a request before the Hon’ble Minister to take it up for hearing expeditiously. However, we refrain from highlighting any exigency or expediency, though the learned Counsel has insisted before us to do so, as we have not touched upon the merits of the matter. With the expectation and hope that the proceedings will __________________________________________________ 12th October, 2026 sg 16.wp(c)13647-26.docx receive consideration in accordance with the pending workload before the Hon’ble Minister, we dispose of the writ petition.
