CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 11.05.2026
01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Puri P.S. Case No.0221 of 2026 corresponding to G.R. Case No.547 of 2026 pending in the file of learned S.D.J.M., Puri on the grounds stated therein. 3. Perused the FIRs as at Annexures-1 & 2. It is alleged by the informant in the FIR that the petitioner, who is her uncle, attempted to murder her grandfather and during that time, she was subjected to sexual harassment. The submission of Mr. Rout, learned counsel for the petitioner is that for the self-same incident, a complaint i.e. Annexure-2 is lodged alleging assault referring the informant. It is claimed that there is no injury to the informant nor to her grandfather. 4. Recorded the objection of the State. 5. This Court finds that the parties are related to each other. The alleged incident took place at the time when the p. 2 informant opposed assault to her grandfather, who is an elderly person aged about 93 years. But, considering the plea that no any injury received by the informant and for that matter, her grandfather and that a complaint was lodged by the petitioner for the self-same incident, this Court, recording the objection of the State, is inclined to direct him to surrender before the learned Court below for being released subject to suitable conditions though his plea of pre-arrest bail is not entertained. 6. Accordingly, it is ordered. 7. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders before the learned S.D.J.M., Puri in connection with Puri P.S. Case No.0221 of 2026 corresponding to G.R. Case No.547 of 2026 within a fortnight from today, he shall be released on bail on furnishing a bail bond of Rs.20,000/-(twenty thousand only) for the like amount and such other terms and conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not commit any further mischief involving the informant in any manner and whatsoever and to furnish an undertaking before the P.S. concerned in that regard.
It is further directed that the above order shall not be given effect to if in case revealed that the informant and her grandfather have received any serious injury for the assault of the petitioner. Alok
