The present writ petition has been filed seeking setting aside of the show cause notice dated 28.08.2026 issued under Section 344(1) and 343 of the Delhi Municipal Corporation Act, 1957 (DMC Act) and another Show Cause Notice dated 09.09.2026 issued under Section 345-A of the DMC Act in respect of the property bearing no. Mr. Sistani, counsel appearing for the petitioner submits that the petitioner has duly replied to the aforesaid Show Cause Notice on 17.09.2026. He further submits that in view of the present position as on date, the petitioner apprehends that demolition/ sealing action will be carried out by the respondent/ MCD (MCD) despite the fact that no Sealing Order or Demolition Order has been passed as yet. 5. Mr. Nath, counsel for the MCD, upon instructions, submits that since neither the Sealing Order nor the Demolition Order has been issued by the MCD till now, the writ petition is way premature as on date. He further submits that the steps which are being taken are only with respect to the encroached areas. 6. In view of the aforesaid, the present writ petition is disposed of. 7. Needless to state, the MCD shall proceed in accordance with law, after granting a personal hearing to the petitioner and/ or calling for further documents, if any, from the petitioner before adjudicating on the same finally on merits, and/ or without being influenced with the observations made by this Court herein. 8. In case of a final disposal thereof by the MCD, against which the petitioner is aggrieved, the petitioner would be at liberty to take appropriate remedies in accordance with law.
