This is the Second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who have been arrested in connection with Crime No. 442/2025 registered at Police Station : Chakarbhatha, District - Bilaspur (C.G.), for the offence punishable under Sections 109, 296, 191(1) and 191(3) of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act. 2. Earlier bail application of the applicant was rejected on merits by this Court vide order dated 06.02.2026 passed in MCRC No. 1352/2026. 3. According to the prosecution story, in brief, the complainant, namely Mukesh Vishwakarma, lodged a complaint at Police Station Chakarbhatha stating that on 26-10-2025, during the night, a meeting PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.12 17:49:58 +0530 2 relating to the Goura-Gouri festival was being held. At about 9:00 PM, the present applicant along with other co-accused persons allegedly started abusing in filthy language. When Ganga Ram Yadav objected to the conduct of the accused persons, one co-accused, namely Vicky, allegedly assaulted him with a sharp-edged weapon on his stomach and back, as a result of which he sustained multiple injuries and was admitted to Chhattisgarh Institute of Medical Sciences for treatment. Thereafter, an offence was registered against the present applicant and other accused persons, and investigation was commenced. 4. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that the first bail application of the applicant was rejected by this Court vide order dated 06.02.2026 passed in MCRC No. 1352/2026. The present second bail application has been filed on the ground that the applicant has been in judicial custody since 27.10.2025 and that the injured, Ganga Ram Yadav, who allegedly sustained injuries on his abdomen and back caused by the applicant with a sharp-edged weapon, has not supported the prosecution case. He further submits that the applicant has no previous criminal antecedents and the charge-sheet has already been filed. Therefore, it is prayed that the applicant be enlarged on bail. 5. On the other hand, the learned counsel for the State opposes the bail application and submits that the first bail application of the applicant was rejected by this Court on the ground that the applicant allegedly assaulted the injured, Ganga Ram Yadav, with a sharp-edged weapon, causing grievous injuries to his stomach and back, hence, the applicant is not entitled to the grant of bail. 6. I have heard learned counsel for the parties and perused the material available on record. 3 7. Taking into consideration the fact and circumstances of the case and the fact that the first bail application of the applicant was rejected by this Court on the ground that the applicant allegedly assaulted the injured, Ganga Ram Yadav, with a sharp-edged weapon, causing grievous injuries to his stomach and back, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the second bail application of applicant – Vicky Thakur involved in Crime No. 442/2025 registered at Police Station : Chakarbhatha, District - Bilaspur (C.G.), for the offence punishable under Sections 109, 296, 191(1) and 191(3) of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
