This is First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.11/2026 (wrongly mentioned as 11/2025 in the bail rejection order), registered at PS - Khadgawan, District - Manendragarh-Chirmiri-Bharatpur, (C.G.) for commission of offence punishable under Sections 137(2), 87, 65(1), 142 of Bharatiya Nyaya Sanhita, 2023 and under Section 4 & 6 of Protection of Children from Sexual Offences Act (POCSO) Act, 2012. 2. In compliance of order dated 13.04.2026, the victim and her father-in-law appeared on 20.04.2026 through video conferencing from the concerned PRAKASH KUMAR Digitally signed by PRAKASH KUMAR Date: 2026.05.11 15:58:28 +0530 2 DLSA, and on being asked, they have raised ‘no objection’ on the application filed by the applicant for grant of bail. 3. The prosecution case, in brief, is that the police received a memo from the hospital and thereafter, the police started the investigation as the victim has given birth to a child and, subsequently, during the course of investigation, the police recorded the statement of the victim in which she stated that the applicant and victim used to study in the same school. They came in contact to each other and the applicant asked the victim that he wanted to marry her. In the month of March, 2025, the applicant came to the village and called the victim and took her towards the forest and established physical relationship with the victim and soon after 15 days, on the pretext of marriage, he established physical relationship with her and when she became pregnant, the applicant took her to his house. On 14.01.2026, the applicant and his family members went to District Hospital, Chirmiri where the victim gave birth to a child. Then on the basis of memo received from the hospital, the police registered the offences against the applicant and subsequently, the applicant was arrested for the commission of the alleged offences. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant who was major at the relevant time, and the victim have performed marriage with each other and they are blessed with a girl child. He further submits that the victim (PW-1) has already been examined wherein she has not supported the case of the prosecution and, as per her statement, the applicant has not committed the alleged act with her. He further submits that applicant is in jail since 16.01.2026, charge-sheet has 3 been already filed and conclusion of trial may take some time, hence, applicant may be released on bail. 5. Per contra, learned counsel for the State opposes the bail application. 6. Heard learned counsel for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, the nature and allegations against the applicant, and upon perusal of the statement of the victim and further considering the fact that victim has raised ‘no objection’ on grant of bail to the applicant, and as the conclusion of the trial may take some time, without commenting on the merits of the case, I am inclined to grant bail to the applicant. 8. Accordingly, bail application is allowed. It is directed that applicant shall be released on regular bail, on his furnishing a bail bond in sum of Rs.10,000/- with one surety in like sum to satisfaction of concerned Court.
