Order 20/01/2026
1. The proceeding of instant Civil Contempt Petition has been initiated by and on behalf of petitioner, stating deliberate and wilful non-compliance and disobedience of the directions issued by Division Bench vide interim order dated 22.07.2024 passed in D.B. Special Appeal (Writ) No 1088/2022, in respect of handing over the original title documents by Khadi & Village Industries
[2026:RJ-JP:2343-DB] (2 of 3) [CCP-1066/2025] Commission, Jaipur (KVIC) to UCO Bank and in turn by UCO Bank to the petitioner i.e. auction purchaser of the property.
2. We have heard counsel for both the parties and perused the material available on record.
3. Vide order dated 16.01.2026, the notices of contempt issued against the respondent No. 1, State Director, KVIC were discharged in view of fact that on that date he had handed over the original title documents to the concerned Branch Manager of UCO Bank and the contempt petition preferred by and on behalf of UCO Bank being D.B. Civil Contempt Petition No.1034/2024 was
disposed of as not pressed.
4. Thereafter, UCO Bank vide letter dated 17.01.2026 i.e. on the next day, has handed over the original title documents so also the sale certificate dated 08.04.2021 and physical possession of the property to the petitioner and petitioner has received the documents as well as physical possession of the property. The letter dated 17.01.2026 bearing signatures from both sides, accepting handing over and receiving the original documents and physical possession of property has been placed on record, which is an admitted and undisputed document, hence, taken on record.
5. In view of the above facts, we find that there is no delay or negligence on the part of UCO Bank, to hand over the original title documents to petitioner. Even the fact has come to fore that sale certificate dated 08.04.2021 and physical possession of property was earlier offered by Bank to petitioner but he declined to receive the same for want of obtaining the original title documents, as well.
[2026:RJ-JP:2343-DB] (3 of 3) [CCP-1066/2025]
6. Be that as it may, the act by and on behalf of UCO Bank may not be considered as contumacious and does not fall within the purview of deliberate and wilful disobedience. As far as, non compliance/disobedience of the directions, by and on behalf of State Director, KVIC is concerned, the issue has already been dealt with in the order dated 16.01.2026 and since he has purged the contempt and submitted an apology, which was accepted by the Court and contempt notice against him has been discharged.
7. In view of the above, nothing survives in the instant contempt petition and the proceedings are hereby closed.
8. Notice(s) of contempt, if any, stands discharged.
