For issuance of an appropriate writ(s), order(s) or direction(s) in the nature of Mandamus commanding upon the Respondent No. 3 to consider the case of petitioners for enrolment to the post of Home Guards being Advertisement No. 1/2016 conducted by the Respondent No. 3 Deputy Commissioner cum District Magistrate since the petitioners were declared successful in all the three lists and they had obtained higher marks and have qualified in all events in terms of advertisement but even though their name do not found place in the final merit list dated 27.12.2022(Annexure-5). For issuance of an appropriate writ(s), order(s) or direction(s) for quashing of the Final List dated 27.12.2022 (Annexure- 5) pursuant to Advertisement No. 01/2016 conducted by the Respondent No. 3 since candidates having less marks have been selected in final merit list. For issuance of an appropriate writ(s), order(s) or direction(s) in the nature of mandamus commanding upon the Respondent No. 3 to publish the fresh revised result in terms and in accordance with law. For issuance of an appropriate writ(s), order(s) or direction(s) calling upon the entire records including the marks statements of all the candidates who have applied for the appointment for the vacancy in pursuant to the Advertisement number 01/2016 (Annexure-1). For issuance of an appropriate order(s) or direction(s) for staying the execution and implementation of recommendation of appointments/ final results dated 27.12.2022 (Annexure- 5) 2026:JHHC:19411 17 published by Respondent No. 3 Deputy Commissioner cum District Magistrate, during the pendency of this writ petition. At the outset, Ld. Sr. Counsel representing the petitioners in the respective writ petitions, assisted by learned counsels Mr. Manoj Kr. Choubey, Mr. Krishna Prajapati, Ms. Tanya Singh, Mr. J.N. Upadhyay, Mr. Rahul Kumar, Mr. Kaushik Sarkhel and Mr. Om Prakash Sharma, fairly submits that, as per their instruction; seats are still available against the respective advertisement with respect to appointment of Home Guards. 4. Accordingly, he submits that the respondents be directed to take a decision in the matter in respect of the respective petitioners, in the background that seats are still vacant. 5. Learned State counsels representing respective writ applications though relied upon the counter-affidavit and submits that as per them, no seat is vacant under non- technical post; however, they submit that if the petitioner/s so chooses, they may approach the concerned respondent. 2026:JHHC:19411 22 6. Having regard to the above, all these writs application stands disposed of by giving liberty to the petitioner/s to approach the concerned respondents i.e. Deputy Commissioner, Ranchi for the claims as indicated in the respective writ applications. 7. The moment the Deputy Commissioner, Ranchi will receive the representation/s he shall verify the record of the case with the help of his subordinate and pass an appropriate order strictly in accordance with law and applicable rules and regulation governing this advertisement within a period of 20 weeks from the date of receipt of such representation/s. 8. With the aforesaid observations, all writ applications stand disposed of without going into the merits of the case. 9. It goes without saying that if at all the claim of any of the petitioner/s is found to be genuine in the eye of the concerned respondent; consequential order be also issued within a further period of six weeks. 10.
