Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:- “i. To issue the Writ of certiorari or writ in the nature of certiorari quashing transfer order dated 19.05.2026 is Annexure P-1 whereby the petitioner has been ordered to join UCO Bank branch at Haripurdhar. ii. To issue the Writ of certiorari or writ in the nature of certiorari quashing the further proceedings initiated by the respondent bank against the present petitioner. i) To issue the Writ of mandamus or Writ of similar nature thereby 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:33471 issuing directions to the respondents authorities to accommodate the petitioner by considering the representation dated 14.07.2026 (Annexure P-9) on compassionate humanitarian grounds and to decide the same representation in a time bound manner.” 2. The petitioner, who is serving as a Branch Manager with the respondent-bank, has been transferred vide order dated 19.05.2026 from Narag to Haripurdhar in District Sirmaur. The basic contention of the petitioner is that his newly born child is suffering from medical issues and on account thereof, he is seeking the quashing of the transfer order or his adjustment at some other station, where decent medical facilities are available. 3. This Court is of the considered view that in light of the fact that the petitioner has been transferred from Narag to Haripurdhar, in case, there is some difficulty with regard to the health condition of his child, then he may approach the competent authority, by way of a representation, appending therewith all the necessary medical documents of the child and the Authority may pass appropriate orders thereupon, taking into consideration the medical report(s) of the child. It goes without saying that if indeed, the child of the petitioner is suffering from some major medical issue(s), then endeavor be made to post the petitioner at a station where medical facilities that can take care of his child are available. 3 2026:HHC:33471 Representation be made by the petitioner within a period of two weeks from today and decision thereupon be taken by the competent Authority within two weeks from the date of receipt thereof. Till then, the petitioner be permitted to avail the leave of kind due to him. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
