Petitioner has filed this writ petition seeking following reliefs:- "10.1. The petitioner craves the indulgence of the Hon’ble Court that this Hon’ble Court may be kind enough to call for the records of the case. 10.2 That, this Hon'ble Court may kindly be pleased to issue a suitable direction to the respondent no.1 for considering the claim of the petitioner with respect to sanctioning of one post of Additional Commissioner in Municipal Corporation, Raigarh pursuant to resolutions passed by Mayor-in-Council on 11/11/2022 and 24/04/2025 within stipulated time interval in the interest of justice. 10.3. To kindly pass any other suitable direction or order or grant any other relief which this Hon’ble Court deems fit under the facts and circumstances of the case" 2. Learned counsel for the petitioner submits that the petitioner has been working as Deputy Commissioner, Municipal Corporation, Raigarh since 22.02.2021. It is further submitted that the Mayor-in-Council has passed resolutions dated 11.11.2022 and 24.04.2025 recommending to the State 3 Government for creation of the post of Additional Commissioner in Municipal Corporation, Raigarh. Hence, the State Government may be directed to consider the said resolutions and sanction/create the post of Additional Commissioner in Municipal Corporation, Raigarh. 3. Learned counsel for the State, on instructions, submits that the creation and sanction of posts/set-up is within the discretion of the State Government. It is further submitted that although the set-up of the Municipal Corporations was last created in the year 2016, presently the State Government is again in the process of creating the set-up for the Municipal Corporations in accordance with law. 4. I have heard learned counsel for the parties. 5. From the aforesaid submission of the parties, it appears that since the Municipal Corporation, Raigarh has already passed the resolutions and submitted its recommendations, the present writ petition is disposed of with a direction to the State Government to consider the matter and pass necessary orders in accordance with law within a reasonable period. 4 6. It is made clear that this Court has not expressed any opinion on the merits of the matter, the State is directed to consider and decide the issue as per the extant rules and on its own merits.
