This criminal revision is filed under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 being aggrieved by the impugned order dated 02.05.2026 passed by the learned Special Juvenile Court (FTC) Korba, District – Korba (C.G) in Criminal Appeal No.63/2026, arising out of order dated 23.04.2026 in Crime No. 136/2026 passed by learned Juvenile Justice Board, Korba, District – Korba (C.G.).

As per the prosecution story, in brief, the complainant lodged a report at Police Station Balconagar alleging that on 04.03.2026, i.e., on the occasion of the Holi festival, a minor dispute arose between the parties, during which both sides abused each other using filthy language and PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.14 12:07:34 +0530 PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.15 10:09:20 +0530
2 engaged in a scuffle. As a result thereof, persons from both sides sustained simple injuries. Based on the said report, the police registered an offence punishable under Sections 296, 115(2), 109(1), 190(2), 190(3), and 3(5) of the B.N.S. against the juvenile applicant and four other persons.

Learned counsel for the applicant submits that the applicant is a juvenile. There is no criminal antecedents against him prior to this case. He also submits that there is total 05 accused persons in this case, out of which this Court has already been granted bail to two other accused persons, namely, Sunil Kenvat and Sirat Kenwat vide order dated 01.05.2026 passed in MCRC Nos. 4053/2026. Further, main accused person Brijlal Kevant @ Jojo and Sunil Das Mahant have also been granted bail by the trial Court vide order dated 11.05.2026 and 06.05.2026, and the same has been explained through covering memo of this bail application. Hence, he prays for grant of bail on the ground of parity.
4. On the other hand, learned State counsel opposes the submission made by learned counsel for the applicant but could not dispute the fact that identically situated co-accused persons have already been granted bail by this Court and trial Court.
5. I have heard learned counsel for the parties and perused the records.

From perusal of records, it appears that the applicant is a juvenile, and there is no criminal antecedents against him prior to this case and further, there is total 05 accused persons in this case, out of which two other accused persons, namely, Sunil Kenvat and Sirat Kenwat have been granted bail by this Court vide order dated 01.05.2026 passed in MCRC Nos. 4053/2026, further, main accused person Brijlal Kevant @ Jojo and Sunil Das Mahant have also been granted bail by the trial Court vide order
3 dated 11.05.2026 and 06.05.2026, thus I am inclined to allow this criminal revision.
7. Consequently, criminal revision is allowed. The judgment dated dated 02.05.2026 passed by the learned Special Juvenile Court (FTC) Korba, District – Korba (C.G) in Criminal Appeal No.63/2026, arising out of order dated 23.04.2026 in Crime No. 136/2026 passed by learned Juvenile Justice Board, Korba, District – Korba (C.G.), and all consequential proceedings arising thereof, are set aside. It is directed that on furnishing a surety of Rs. 50,000/- along with a bond of same amount which are to be of his natural guardian/father/mother, to the satisfaction of the concerned Juvenile Justice Board, for this appearance as when directed, the applicant shall be given in custody of his natural guardian/father/mother.
