JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayers: "a) Set aside the Order dated 28-Jan-2026 taking cognizance against the Petitioner and quash all further proceedings in CC No.5649 of 2026 pending on the file of the Hon'ble Court of VI Additional Chief Judicial Magistrate Bengaluru against the Petitioner, marked at Annexure - D in the interest of justice; - 3 - HC-KAR NC: 2026:KHC:25835 CRL.P No. 6379 of 2026 b) Quash the charge sheet in Crime No.0052 of 2025 filed on 28-Jan-2026 before the Hon'ble Court of VI Additional Chief Judicial Magistrate Bengaluru, registered by S J Park Police Station for the offence punishable under Section 125 of the Bharatiya Nyaya Sanhita, 2023 produced at Annexure - C in the interest of justice; c) Quash the First Information Report bearing Crime No.0052 of 2025 dated 15-May-2025 registered at S J Park Police Station, marked at Annexure - B, in the interest of justice; d) Quash the complaint filed by Respondent No.2 dated 15-May-2025 before the S J Park Police Station, marked at Annexure - A, in the interest of justice. e) Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interests of justice." 2. Heard Sri.Sachin S Deshpande, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Vishwas N.B, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Memo of Compromise to that effect. The Memo of Compromise reads as follows: - 4 - HC-KAR NC: 2026:KHC:25835 CRL.P No. 6379 of 2026 "The counsel for the Petitioner and the counsel for the Respondent No.2 respectfully submit as under: 1. The Petitioner herein - Sri. Narasimhamurthy Kariyanna and the Respondent No.2 / Complainant, Sri. Sumanth Kumar H G, have amicably resolved all disputes arising out of the incident dated 05.05.2025, which forms the subject matter of Crime No.0052 of 2025 registered by S J Park Police Station and the consequent proceedings in CC No.5649 of 2026 pending before the Hon'ble Court of VI Additional Chief Judicial Magistrate, Bengaluru. 2. The Petitioner, without admitting any liability and solely with a view to bring an end to the disputes between the parties, has voluntarily agreed to pay a sum of Rs.45,000/- (Rupees Forty-Five Thousand Only) to the Respondent No.2, being equivalent to three months' salary as earlier assured. The Respondent No.2 has agreed to accept the said amount in full and final settlement of all claims arising out of the incident. The Petitioner has paid the entire amount of Rs.45,000/- (Rupees Forty-Five Thousand Only) to the Respondent No.2 through Phonepe/Gpay, and the Respondent No.2 hereby acknowledges receipt of the same. 3. The Respondent No.2 unconditionally withdraws all allegations made against the Petitioner and states that he has no objection whatsoever to the quashing of the Complaint dated 15.05.2025, FIR in Crime No.0052 of 2025 registered by S J Park Police Station, the charge sheet filed pursuant thereto, and all consequential criminal proceedings pending in CC No.5649 of 2026 before the Hon'ble Court of XLVIII Additional Chief Judicial Magistrate, Bengaluru. The Respondent No.2 further undertakes that he shall not initiate or pursue any further civil or criminal proceedings against the Petitioner in respect of the said incident. 4. Both parties submit that the present settlement has been arrived at voluntarily, out of their own free will, without any force, coercion, undue influence or pressure from any quarter. The parties further submit that the compromise is in the larger interest of justice and would bring a quietus to all disputes arising out of the incident. 5. This Memo of Compromise is being filed jointly before this Hon'ble Court with a request to record the settlement arrived at between the parties and to exercise the powers under - 5 - HC-KAR NC: 2026:KHC:25835 CRL.P No. 6379 of 2026 Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the Complaint, FIR, charge sheet and all consequential proceedings in view of the amicable settlement reached between the parties." 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Memo of Compromise being filed and offences not being against the State, I deem it appropriate to accept the Memo of Compromise and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Order dated 28.01.2026 taking cognizance against the Petitioner is set aside and all further proceedings in C.C.No.5649/2026 pending before the Hon'ble Court of VI Additional Chief Judicial Magistrate Bengaluru, qua the Petitioner stands quashed. - 6 - HC-KAR NC: 2026:KHC:25835 CRL.P No. 6379 of 2026 [III] Charge sheet in Crime No.0052 of 2025 filed on 28.01.2026 pending before the Hon'ble Court of VI Additional Chief Judicial Magistrate, Bengaluru, registered by S J Park Police Station for the offence punishable under Section 125 of the Bharatiya Nyaya Sanhita, 2023, stands quashed qua the petitioner.
