Order 08/01/2026
1. Apprehending his arrest in connection with FIR No.540/2020 registered at Police Station Sanganer, District Jaipur City (East) for the offences under Section 420 of IPC and Sections 4 and 6 of Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992, the accused-petitioner has preferred the anticipatory bail application under Section 482 BNSS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case solely on the grounds that co-accused Bhupender Saran in his disclosure statement has named the petitioner. It is also contended that there is no substantive evidence available on record that the petitioner arranged & provided candidates to the co-accused
[2026:RJ-JP:566] (2 of 3) [CRLMB-12473/2025] Bhupender Saran to appear in the subject of hindi and other conducted by RPSC for the post of SI in the year 2021. The petitioner is ready and willing to cooperate with the investigation and in the other 2 cases which were lodged against the petitioner, has he already been granted interim protection, therefore, anticipatory bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application. The Investigating Officer Mr. Nihaz Mohd., is present before the Court. It is contended by learned Public Prosecutor that co-accused Bhupender in his disclosure statement has clearly stated that the petitioner sent several candidates to him and in view of that has taken Rs.40,00,000/-. It is also contended that a diary was recovered from the co-accused Bhupender in which it is written that accused-petitioner has given Rs.40,00,000/-. It is also contended that two other cases of similar nature were also registered against the petitioner, however, the petitioner is not cooperating with the investigation, therefore, considering the gravity of the offence, the anticipatory bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. Apart from the disclosure statement of co-accused, there is no evidence available on record that the petitioner for SI examination conducted in the year 2021, gave an amount of Rs. 40,00,000/- to the other co-accused Bhupender. In the other criminal cases registered against the petitioner, the petitioner has been granted interim protection, therefore, considering the above
