2.

He further submits that the material eye witnesses PW-4 Soobhagmal, PW-7 Deen Dayal and PW-8 Ram Gopal have turned hostile and not supported the prosecution story. The similarly placed co-accused Naval Kishore has already been enlarged on bail by the co-ordinate Bench of this Court vide order dated
[2026:RJ-JP:2617] (2 of 3) [CRLMB-12667/2025]
16.10.2025. The accused-petitioner is in custody since 12.11.2024 and further trial of the case may take considerable time and charge-sheet has already been submitted, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioner along with the other co-accused assaulted the deceased and the said incident was captured in a mobile video prepared by PW-4 Soobhagmal and PW-4 Soobhagmal handed over the mobile to the police and the same was recovered, in the video, the petitioner was seen beating the deceased. The statement of the Investigating Officer who recovered the mobile is to be recorded, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. The co-ordinate Bench vide order dated 16.10.2025 has enlarged the co-accused Naval Kishore on bail and the allegation against the present petitioner is akin to the other co-accused, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6.
