1. This application is jointly filed on behalf of the parties under Order XXIII Rule 3 CPC for recording of settlement. 2. This suit is instituted by the Plaintiffs inter alia seeking a decree of permanent and mandatory injunction restraining the Defendant and all others acting on its behalf from manufacturing, selling, offering for sale, advertising, directly or indirectly dealing in pharmaceutical preparations under the impugned mark SILOGREAT-D8 or any other mark deceptively similar to the Plaintiff/Applicant's registered trade mark "SILOGREAT" amounting to infringement of Plaintiff/Applicant's trade mark registration number 4976113 and passing off. 3. During the pendency of the suit, parties were referred for mediation This is a digitally signed order. before the Delhi High Court Mediation and Conciliation Centre, where they have amicably settled their inter se disputes and executed a Settlement Agreement dated 10.07.2026, incorporating the terms of settlement. Copy of the Settlement Agreement is on record. 4. Court has perused the terms of the settlement and finds the same to be lawful. Accordingly, the application is allowed and disposed of recording the settlement between the parties. CS(COMM) 1101/2025 & I.A. 25560/2025 (u/O XXXIX Rules 1 and 2 CPC)
5. Suit is decreed in terms of the settlement between the parties. As agreed between the parties, the impugned products bearing the offending mark which were seized by the Local Commissioner and released to Defendant on superdari shall be destroyed in presence of the authorized representatives of the Plaintiff and the Defendants on 12.10.2026 at 02:30 PM. Photographs of the destruction proceedings shall be taken and preserved by both the parties. 6. Needless to state that Settlement Agreement dated 10.07.2026 shall form a part of the decree and terms thereof shall bind the parties thereto. 7.
Registry is directed to draw up the decree sheet. 8. Suit along with the pending application stands disposed of. 9.
