The present petition has been filed seeking directions to respondents to not change the service conditions of the petitioners during the pendency of the industrial dispute. 2. Learned Senior Counsel appearing for the petitioners submits that conciliation proceedings, which have been filed by the petitioners on 25th August, 2026, upon filing of their statement of claim seeking regularisation This is a digitally signed order. This Court is further informed that the petitioners were initially engaged in the year 2014. 4. Learned Senior Counsel appearing for the petitioners further submits that the petitioners were disengaged for a short period. 5. He submits that as regards petitioner no. 1, he was disengaged from service on 08th December, 2021, to 26th June, 2023, while petitioner no. 2 was disengaged from service on 10th December, 2021, to May, 2024. 6. Learned Senior Counsel appearing for the petitioner further submits that subsequently they were again engaged by the New Delhi Municipal Council (“NDMC”) through a contractor and have been continuously working. 7. Per contra, learned counsel appearing for respondent no. 1-NDMC submits that from the reading of the petition, it is clear that the petitioners are continuing to work with respondent no. 1-NDMC uninterruptedly and that no obstruction as such has been created in their employment. 8. He, thus, submits that the present petition is a premature in nature. 9. Considering the submissions made before this Court and noting the fact that the petitioners are continuing to work with the respondent no. 1- NDMC, it is directed that the provisions Section 90 of the IR Code/Section 33 of the now repealed ID Act, shall not be contravened, in any manner whatsoever, on account of the fact that the petitioners have approached the Conciliation Officer with a prayer for their regularisation. 10. Needless to state, this Court has not expressed any opinion on the merits of the case of the petitioners for regularisation. This is a digitally signed order.
