02/20.02.2026 Heard learned counsel for the parties.
2. The petitioners are accused in a case registered for the offence punishable under Sections 309(5)/312 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Sections 25(1-B)(a)/26/35 of the Arms Act.
3. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and have not committed any offence as alleged in the F.I.R. There is alleged recovery of one country made pistol and two live cartridges from the possession of each of the petitioners. In fact, there is no such recovery from the petitioners as has been alleged. False implication of the petitioners would be evident from the fact that the seizure lists prepared in this regard do not contain signature of any independent witness. Though the petitioners have criminal antecedent, yet they have been implicated in this case without any cogent evidence. The petitioners are in judicial custody in the present case since 14.10.2025 and therefore they may be given the privilege of regular bail.
4. Learned A.P.P opposes the petitioners’ prayer for bail.
5. Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioners on bail. Accordingly, the above named petitioners are directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) each with two sureties of the like amount
