This petition under Section 482 of BNSS, 2023, is filed by accused no.2 with a prayer to grant anticipatory bail in Crime No.129/2025 registered by Chamarajanagar East Police Station, Chamarajanagar, for the offences punishable under Sections 103 read with 3(5) of BNSS, 2023. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.129/2025 was registered by Chamarajanagar East Police Station, for the aforesaid offences against Mahesha and the petitioner herein, based on the first information dated 30.06.2025 received from Shruthi - sister of deceased Shubha. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.5/2026 before the jurisdictional Sessions Court, Chamarajanagar, which was rejected on 14.01.2026. Therefore, she is before this Court. - 3 - HC-KAR NC: 2026:KHC:26350 CRL.P No. 3845 of 2026 4. Deceased Shubha was the wife of accused no.1 - Mahesha who is the son of the petitioner herein. From the wedlock between the deceased and Mahesha, they have a son aged about 15 years. In the first information, it is alleged that Mahesha was ill-treating his wife and this was informed by her to her family members. On 30.06.2025, the first informant was informed by her relatives that accused no.1 had assaulted his wife and committed her murder. It is in this background, FIR was registered in Crime No.129/2025. 5. During the course of investigation, accused no.1 was arrested and remanded to judicial custody. After completing the investigation, charge sheet has been filed against two persons. Petitioner who is the mother of accused no.1 is arrayed as accused no.2. In the charge sheet, it is alleged that accused no.1 who was facing financial problems was pestering his wife for money and was ill-treating her. He also was suspecting her character. On 30.06.2025 at about 4.00 a.m., accused no.1 had assaulted his wife Shubha with iron rod and had committed her murder. The allegation against the petitioner who is the mother of accused no.1 is that, though she knew about the said - 4 - HC-KAR NC: 2026:KHC:26350 CRL.P No. 3845 of 2026 murder committed by her son, she had suppressed the same and had tried to mislead others. Except the said allegation, there is no other allegation as against the petitioner who is a lady aged about 65 years. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.129/2025 registered by Chamarajanagar East Police Station, Chamarajanagar, for the offences punishable under Sections 103 read with 3(5) of BNSS, 2023, subject to the following conditions: 1. The petitioner shall appear before the jurisdictional Court and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the said Court. 2.
